1.1 The Hirer must complete the Hire Agreement before taking possession of any equipment or commencing any trip.
1.2 For Groups, each member of the group should sign the Hire Agreement ensuring that each member of the party is fully aware of the risks and health and safety issues involved, any person under the age of 18 must be signed on behalf of by a parent or guardian.
1.3 All group members must be individually named on the Hire Agreement and each must affirm:
a. Their acceptance of the terms of the Hire Agreement and the Hirer’s Obligations (Section 4, below);
b. That they have disclosed any medical conditions from which they suffer in respect of asthma, diabetes, epilepsy and heart disease;
c. That the hazards and safety rules have been explained to them by Wye Canoes Ltd, and that they are clearly understood.
The ‘Company’ is Wye Canoes Ltd. The ’Hirer’ is any person or company who hires or has agreed to hire Goods from the Company. ‘Goods’ means goods provided by the Company detailed on the hire schedule together with any accessories described for the period of hire shown thereon, upon the terms and conditions set out in the agreement including those set out on the hire schedule.
The customer’s acceptance of equipment on hire implies acceptance of the Company’s Conditions of Hire outlined below:
The Hirer shall:
4.1 USE AND LOCATIONS: keep the Goods in their possession and under their control at all times and use the Goods only within the area of, and for the purposes of, their trip as previously agreed with the Company.
4.2 ALLOW INSPECTION: permit the Company’s representative access to the Goods at all reasonable times, for the purpose of inspecting, repairing or removing the Goods.
4.3 LOSS OR DAMAGE: be responsible for losses of, or damage to, the Goods caused by their own fault and will be charged in full for any such loss or damage at the end of their hire period.
4.4 SALE OR LETTING ETC: not sell, underlet, or dispose of the Goods, and will indemnify the company against all losses, costs, claims, damage and expenses howsoever occasioned by their breach of these conditions.
4.5 ALCOHOL: Alcohol can only be carried for overnight trips. Consumption of alcohol in boats is prohibited and any Hirer caught consuming alcohol within their boat will be in breach of the hire agreement.
4.6 UNRULY BEHAVIOUR: Hirer’s should act in a reasonable manner and respect other river users. Any unruly behaviour may result in the Hirer’s agreement being terminated, any damage caused by unruly behaviour will be charged for.
4.7 BUOYANCY AIDS: Hirers should not remove or undo buoyancy aids whilst on or around the water.
The Company confirms that all goods hired will be in a full working condition, provided that the Hirer has abided by all their obligations outlined above.
The Hirer assumes complete responsibility for loss of or damage to the hire equipment (other than fair wear or tear) from the time the Hirer takes possession of the equipment. To this end, it is the responsibility of the Hirer to arrange insurance cover to provide for the risks of: Theft, Fire, Accidental Damage, Loss, Personal Injury and Public Liability.
Any breach of this agreement on the Hirer’s part may result in the termination of the agreement without any refund and the continued possession of the Goods will be without the consent of the Company and authorities may be contacted.
- GENERAL HIRE
50% Deposit is non-refundable. Cancellations made by the customer within 7 days of the first day of hire but more than 48 hours before their trip/event a charge of 50% of the hire charge will be levied or rescheduled, If cancellation is made within 48 hours of the start of the booking then the hire costs will be charged in full. Cancellation by the Company due to adverse river levels / extreme weather conditions or events outside their control re-arrangement of the booking will be attempted for a later date or gift voucher issued. Refunds will be processed within 28 days of date of activity.
Customers that are unable to attend their event/booking due to COVID-19 have up to 48 before the event to re-schedule for a later date, put their booking on hold for 3 years or receive a voucher that can be redeemed within 3 years. Gift Vouchers - cancellations made within 7 days of booking may be rescheduled - but no refund will be given, cancellations made within 48 hours of the start of the booking the voucher will be no longer valid and cannot be reused.
The Company will not be liable for any death, personal injury, or loss of or damage to goods arising out of the hire of any items by them unless that death, personal injury or loss of, or damage to the goods arises directly from a negligent act or default on the part of the Company.
